GENERAL TERMS AND CONDITIONS - Yu Pilates by Nicole

Yu Pilates is legally registered in Leiden at Hogewoerd 128, 2311HT, Leiden. It is operating under the trade name Yu Pilates and hereinafter referred to as "Yu Pilates by Nicole".

Participant(s): Anyone who has entered into a Participant Agreement with Yu Pilates by Nicole.

Participant Agreement: The agreement between Yu Pilates by Nicole and a Participant.

Participant Terms: These general terms and conditions, which are published on the Yu Pilates by Nicole Website and will be provided to a Participant upon request.

Credit: The credit or balance that a Participant has purchased through the Website to book and/or attend a class at Yu Pilates by Nicole Studio within the specified period (Term).

Class: Any (individual or group) class given by or on behalf of Yu Pilates by Nicole given in the Yu Pilates by Nicole Studio.

Personal Data: All data provided by a Participant to Yu Pilates by Nicole Studio as stated in the Participant Agreement.

Studio: The studio operated by Yu Pilates by Nicole, as listed on the Website.

Term: The period from the purchase of Credit during which a Participant is entitled to attend a Class or a limited number of Classes.

Website: The website of Yu Pilates by Nicole:

ARTICLE 2 - GENERAL

2.1 Every Participant is required to familiarize themselves with these Participant Terms of Yu Pilates by Nicole. If there is a Participant Agreement between Yu Pilates by Nicole and a Participant, these general terms and conditions are an integral part of that agreement.

2.2 The rights arising from a Participant Agreement are strictly personal.

2.3 Yu Pilates by Nicole reserves the right to limit the total number of registered participants, as well as to change opening hours, class times, the number of classes, and rates.

2.4 Yu Pilates by Nicole also reserves the right to refuse Participants in cases of misuse of the subscription system or the facilities of Yu Pilates by Nicole, or in cases of inappropriate behavior.

2.5 Wearing clean sportswear and grip socks is mandatory. Shoes are not allowed in the Reformer spaces.

2.6 The Yu Pilates by Nicole Studio is smoke-free.

2.7 It is prohibited to consume in front of the premises Yu Pilates by Nicole Studio drinks and/or food without proper disposal, except for bottles or sealable plastic water bottles.

2.8 Yu Pilates by Nicole reserves the right to close the entire day or part of the day on recognized public holidays or during renovations.

2.9 Children under the age of 18 are not allowed at Yu Pilates by Nicole, except when accompanied by their parents and with explicit permission from Yu Pilates by Nicole staff. It is also prohibited to leave children waiting while their parent(s) attend a class. Children under 16 are not allowed in the Reformer space or during classes, as we cannot guarantee their well-being. Any injuries or damage to property caused by unauthorized access to the Studio by children are at their own risk.

2.10 Pets are not allowed at Yu Pilates by Nicole Studio.

ARTICLE 3 - APPLICABILITY

3.1 These Participant Terms apply to all legal relationships between Yu Pilates by Nicole and a consumer (Participant) who has purchased Credit and/or participates in a Class offered and/or provided by Yu Pilates by Nicole, and/or on Credit purchased by a consumer (Participant).

3.2 By purchasing a class or participating in a Class, the Participant agrees to these Participant Terms.

3.3 All provisions in these Participant Terms are also written for the benefit of all directors of Yu Pilates by Nicole and all persons employed by or contracted by Yu Pilates by Nicole.

3.4 Deviations from these Participant Terms are only valid if expressly agreed to in writing.

3.5 Yu Pilates by Nicole can amend these Participant Terms at any time. The most recent version is always the valid version and is available on the Website. A copy of the Participant Terms will be provided upon request.

ARTICLE 4 - PARTICIPANT AGREEMENT

4.1 The Participant Agreement between the Participant and Yu Pilates by Nicole is concluded when (a) the Participant fills in all requested information as stated in the Participant Agreement and signs it, (b) through mutual consent, as evidenced by the (online) registration of a Participant, or (c) the Participant has used the facilities of Yu Pilates by Nicole or attended a Class. The Participant Agreement is entered into for an indefinite period and may be terminated in accordance with Article 5 of these Terms and Conditions.

4.2 The Participant will receive a username and password for the Yu Pilates by Nicole registration system during or immediately after registration.

4.3 The completed Participant Agreement and these Terms and Conditions together constitute the full representation of the rights and obligations of Yu Pilates by Nicole and the Participant and replace all prior written and verbal statements, agreements, and other correspondence.

4.4 The Participant ensures that all data, which Yu Pilates by Nicole considers desirable or which the Participant reasonably should understand to be necessary for the execution of the Participant Agreement, is provided to Yu Pilates by Nicole in a timely manner.

4.5 An agreement between Yu Pilates by Nicole and a Participant consists of one or more Credit(s), which entitle the Participant to participate in (a limited number of) Class(es) during the Term. Credits therefore have a limited validity. The individual validity period is specified in the Participant's account on the Website. Once a Credit and/or a bundle of Credits has expired or been used up, the Participant can no longer register for a Class.

4.6 In the case of serious injuries, long-term illness, pregnancy, or an extended stay abroad, the validity of a Credit or a bundle of Credits may be suspended with written consent from Yu Pilates by Nicole. Yu Pilates by Nicole has the right to request proof before a suspension request is approved.

4.7 Credit(s) and/or a bundle of Credits expire automatically. Credit(s) and/or a bundle of Credits will not be automatically renewed.

4.8 The Participant Agreement is personal, and the Participant is not entitled to transfer the rights and obligations from the Participant Agreement, in whole or in part, to third parties.

4.9 If a Participant has concluded a Participant Agreement with Yu Pilates by Nicole, the Participant has the right to revoke the agreement within 14 (fourteen) days after signing the Participant Agreement.

4.10 If the Participant revokes the Participant Agreement in accordance with Article 4.9, the Participant will receive a refund of all payments made to Yu Pilates by Nicole, unless the Participant has already used the facilities of Yu Pilates by Nicole Studio and/or attended a Yu Pilates by Nicole Studio.

4.11 If the Participant decides to purchase a new/additional subscription from Yu Pilates by Nicole, the terms of the Participant Agreement and these Terms and Conditions remain fully in effect, unless expressly agreed otherwise in writing.

4.12 Any changes to an already concluded Participant Agreement may only be made with prior written consent from Yu Pilates by Nicole. Changing a Participant Agreement may incur costs for the Participant.

ARTICLE 5 - PRICES AND PAYMENT

5.1 The current prices for one Credit, a bundle of Credits, or a Membership are listed on the Website. The most recent prices are always valid and available on the Website. Price increases will not affect Credits, Memberships, or bundles of Credits that have already been purchased and paid for.

Return Policy for Retail and Merchandise

5.2 Unwashed, unworn, and tagged items may be returned for a refund or a Yu Pilates by Nicole store credit within 14 days of purchase.

5.3 A receipt or proof of purchase must be provided to process the refund. All discounted items and accessories, including but not limited to grip socks and water bottles, may not be returned unless otherwise stated.

5.4 Unless otherwise agreed, payments must be made through the online payment system or in person at Yu Pilates by Nicole. Credits, Memberships, bundles of Credits, and retail items must be fully prepaid.

5.5 Payments made by a Participant are non-refundable, unless the Participant makes a valid revocation as defined in Article 4.7.

5.6 Yu Pilates by Nicole reserves the right to index and adjust its prices and rates.

5.7 If Yu Pilates by Nicole's facilities cannot be fully used due to circumstances beyond its control, the fees owed by the Participant for the use of Yu Pilates by Nicole's facilities will not be refunded.

5.8 No rights can be derived from promotions or special offers before or after their validity period.

5.9 A member may not exchange a class for cash, and a class may not be transferred to another person unless written consent has been granted by Yu Pilates by Nicole.

5.10 The member's credit/debit card will be charged at the time the classes are purchased, not when the classes are booked.

5.11 All introductory offers, promotions, and discount codes are for one-time use per individual, unless expressly stated otherwise.

5.12 It is the member's own responsibility to stay informed about price changes or the expiration of classes/credits after the expiration of introductory offers, promotions, discount credits, or memberships.

ARTICLE 6 - PARTICIPATION, CANCELLATION, AND RESCHEDULING OF CLASSES

6.1 To make a reservation, a member must first have a single class, multiple classes, or a membership. To purchase a class, multiple classes, or a membership online, a member must register via the Website and App by creating a personal email address and password. If already registered, a member can log in to purchase classes or memberships and make reservations.

6.2 Classes/credits have an expiration date, which is listed on the pricing page of the Website and the App, and future prices may be subject to change.

6.3 Yu Pilates by Nicole accepts payments via MasterCard, Visa, American Express, Maestro, Ideal, Apple Pay, and Google Pay.

6.4 The member's credit/debit card will be charged when the reservation is submitted. Yu Pilates by Nicole does not process reservations where an incorrect, expired, or overdrawn credit card is used. Yu Pilates by Nicole will try to contact the member in such cases. If a member fails to pay due fees or costs, services or privileges may be suspended and/or terminated. The member is liable for any external costs, including attorney fees and collection costs, incurred by Yu Pilates by Nicole in attempting to collect unpaid balances.

6.5 A Participant must register in advance for a Class via the designated online registration system. Without registration, a Participant has no right to attend a Class.

Correct Studio Selection

6.6 Choose the correct studio when booking. Booking at one studio and showing up at another studio is not allowed and will be considered an invalid booking.

6.7 In addition to the member's right to cancel and receive a refund, a member may cancel a reserved class up to 12 hours before the start of the respective class. In that case, the unused class will be rebooked to the member's account to be used at a later time.

Timeliness

6.8 Arriving on time is required, as participation after the start of the class is not allowed. Please note that being late will result in the loss of your Credit.

First-Time Clients

6.9 For clients attending Yu Pilates by Nicole for the first time: for safety reasons, an introduction to the class is required and will be given 5 minutes before the class starts. New participants must be present at least 5 minutes before the start of the class.

6.10 Yu Pilates by Nicole has the right to adjust the training schedule and/or locations at any time without providing a reason. The most recent schedules and locations are always valid and available on the Website.

6.11 Yu Pilates by Nicole has the right to cancel a Class if there is insufficient interest until the start of the Class. In that case, one of the Participant's Credits will be refunded.

6.12 Extraordinary circumstances always constitute force majeure for Yu Pilates by Nicole and exempt Yu Pilates by Nicole from its obligations. In the case of ongoing force majeure, Yu Pilates by Nicole is relieved from the obligation to fulfill the agreement.

6.13 If a Participant causes discomfort or disturbance that impedes the proper execution of a Class, Yu Pilates by Nicole may exclude them from the Class. Any resulting costs will be borne by the Participant.

6.14 Yu Pilates by Nicole aims to accommodate everyone. If a Participant cancels late twice (or more) within two weeks, Yu Pilates by Nicole may apply a measure preventing online booking for two (2) weeks, and all appointments in the schedule will be removed.

6.15 If a Participant has reserved a spot on the waitlist, they will receive an email when a spot becomes available. The Participant must confirm their participation in the respective class via this email. A 12-hour cancellation policy applies here as well. If the Participant cancels less than 12 hours before the class or does not show up after confirming, the full amount will be charged.

ARTICLE 7 - CREDITS & MEMBERSHIP

7.1 For each bundle package, it is indicated how many times the Lessons can be attended during the Term. Unused Lessons during the Term will automatically expire.

7.2 One Credit/lesson entitles the participant to attend one Lesson.

7.3 The Member acknowledges that they are entering into the membership for the agreed duration as specified on the website and the Application, starting from the date of purchase of the first 4 (four) weeks of membership.

7.4 Yu Pilates by Nicole offers 3 (three) types of Unlimited Memberships, namely:

Unlimited Membership 1-year contract, worth 195 euros per 4 weeks.
Unlimited Membership Flex, worth 211 euros per 4 weeks. This Membership has a minimum duration of 4 weeks.
Unlimited VIP Membership 1-year contract, worth 235 euros per 4 weeks.
Unlimited VIP Membership 1-year Advanced Payment, worth 2.300 euros annually.

7.5 The prices as stated in the Article of these Terms and Conditions include VAT. Yu Pilates by Nicole has the right to adjust its rates at any time in case of changes in the VAT rate.

7.6 The Unlimited Membership 1-year contract, worth 195 euros per 4 weeks, has a minimum duration of 1 year. The Member cannot cancel the Membership within this year. After the first year, the Membership will automatically renew every 4 weeks. You may cancel the renewal with a notice period of 4-weeks prior renewal.

7.7 The Unlimited Membership Flex, worth 211 euros per 4 weeks, has a minimum duration of 4 weeks. The Membership will automatically renew every 4 weeks. The Member may cancel the Membership at any time with a notice period of 4 weeks. This notice period starts after the next 4-week period.

7.8 The Member is required to settle any outstanding payments before the termination date. If this obligation is not met, 2 (two) official warnings will be sent to the Member, followed by the involvement of a collection agency to collect the outstanding payments. Yu Pilates by Nicole is entitled to refuse access to the facilities and/or suspend the Membership for the Member who does not fulfil this obligation until all outstanding payments have been settled.

7.9 The Membership is strictly personal and can only be transferred with the consent of Yu Pilates by Nicole. Such a request must be made in writing by the Member who holds the Membership, to the official email address of Yu Pilates by Nicole: info@yupilatestudio.nl.

7.10 Yu Pilates by Nicole reserves the right to request identification from Members present on the premises at any time.

Membership Costs

7.11 Membership costs must be paid by the Member via SEPA direct debit, a valid credit card, or through a payment link sent to the Member's email address, for the entire 4-week period of the membership, in advance, on a 4-week basis, or, if necessary, for the initial or remaining term of the contract (or an extension thereof).

7.12 Yu Pilates by Nicole reserves the right to collect overdue payments.

7.13 If a SEPA direct debit or credit card payment is rejected, Yu Pilates by Nicole will automatically send a written reminder to the Member, requesting payment of the outstanding balance as soon as possible. If the payment remains incomplete, 2 (two) official warnings will be sent in writing to the Member, followed by the involvement of an external collection agency to recover the outstanding payment.

7.14 If Yu Pilates by Nicole is required to engage a collection agency to recover a payment from the Member, the Member will also be required to pay administrative costs and any out-of-court collection fees in accordance with the collection fee scale. The Member is not entitled to use the services and facilities of Yu Pilates by Nicole until the overdue debt is settled according to the agreement with the collection agency.

Cancellation

7.15 Cancellation of a subscription is possible with a notice period of 4 weeks at the end of the contract period. The 4-week notice period starts after the last payment period. The subscription must remain active during the 4-week notice period. For example, if a Flex subscription was purchased on March 5 and canceled on March 20, the end date would be April 29 (end of the last payment period + 4 weeks).

7.16 Cancellation and expiration of Yu Pilates by Nicole packages are arranged as follows:

Single Lesson: Participants can purchase a single lesson through the website or app. A single lesson entitles the participant to attend one lesson within the validity period, as indicated in the participant’s account. The validity period of a single lesson is indicated at the time of purchase and cannot be extended. The lesson cannot be refunded or canceled after purchase.
Introductory Package (3-intro-classes): This package is available once to new members and has a limited validity period as stated on the website. It cannot be canceled or extended. All unused lessons will automatically expire after the validity date.
5-pack: This package entitles the participant to attend 5 lessons within the validity period, which is indicated in the participant's account on the website and app. Unused lessons will automatically expire after the expiration date of the package. The package cannot be canceled or extended midway.
10-pack: This package entitles the participant to attend 10 lessons within the validity period, which is indicated in the participant's account on the website and app. Unused lessons will automatically expire after the expiration date of the package. The package cannot be canceled or extended midway.
20-pack: This package entitles the participant to attend 20 lessons within the validity period, which is indicated in the participant's account on the website and app. Unused lessons will automatically expire after the expiration date of the package. The package cannot be canceled or extended midway.

7.17 Cancellation of a subscription is possible with a notice period of 4 weeks at the end of the agreed contract period, depending on the type of Yu Pilates by Nicole subscription:

Yu Pilates by Nicole 1-year commitment subscriptions: This subscription can only be canceled after the first 12 months. The 4-week notice period starts after the last payment period of the subscription.
Yu Pilates by Nicole Flex subscriptions: This subscription can be canceled at any time with a notice period of 4 weeks. The notice period starts after the next payment period.

The notice periods and terms for the packages differ from those for subscriptions and apply to the specific period as stated at the time of purchase.

7.18 Cancellation must be done in writing by sending a request to the official email address of Yu Pilates by Nicole, namely info@yupilatestudio.nl , and must be confirmed by the Member upon receipt of the formal end date of the subscription as determined by Yu Pilates by Nicole in accordance with Article 6.1 of these Terms and Conditions. Oral requests to cancel the subscription at the reception or by calling the staff will be considered invalid cancellation requests.

Freezing the Subscription

7.19 Freezing of packages and subscriptions: At Yu Pilates by Nicole, it is not possible to temporarily freeze a subscription or package, regardless of the type of subscription or package. During the validity period of the package or subscription, the lessons must be used, as freezing or extending is not offered.

ARTICLE 8 - TERMINATION OF PARTICIPANT AGREEMENT

8.1 The participant may cancel the Participant Agreement in writing, with a notice period of one (1) month. Upon receipt of the written cancellation, Yu Pilates by Nicole will send a confirmation to the participant within fourteen (14) days. If the participant does not receive this confirmation in time, they must immediately contact Yu Pilates by Nicole; otherwise, it will be assumed that the cancellation was not received or was not submitted in time.

8.2 The participant may delete their account at any time via the Website or Mobile App.

8.3 In the event of long-term illness, injury, and/or pregnancy of the participant, the Participant Agreement may be temporarily suspended or terminated after consultation and submission of a medical certificate.

8.4 Yu Pilates by Nicolehas the right to terminate the Participant Agreement immediately if:

The participant behaves unacceptably, as defined by Yu Pilates by Nicole internal code of conduct.
The participant repeatedly violates the rules of Yu Pilates by Nicole.
A third party uses the participant's membership card through negligence or with the knowledge of the participant.

8.5 In the event of national restrictions or special government measures that prohibit the operation of gyms, and thus Yu Pilates by Nicole, a collective suspension of all active memberships for an indefinite period may be imposed, or until the national restrictions or government measures change, and regular services can be resumed. The scope, extent, and duration of the special collective suspension will be determined by Yu Pilates by Nicole, and in such a case, members will receive a digital notification via email with information about the event, the (expected) duration, and other important details. In the case of a collective suspension, the provisions of Article 7.5 take precedence.

8.6 In the event of national restrictions or special government measures that limit but do not prohibit the operation of gyms, allowing Yu Pilates by Nicole to continue offering (limited) services, Yu Pilates by Nicolereserves the right to keep memberships active according to the provisions of these terms. Members may submit a personal, written request for a temporary suspension according to the procedures in Article 7.1 of these terms. In such a case, the provisions of Article 7.5 take precedence.

8.7 The membership can never be suspended retroactively.

8.8 The Member's payment obligation will be postponed until the actual duration of the suspension. The end date of the membership will be extended by the duration of the suspension. This also applies in exceptional circumstances, such as national restrictions or emergency government measures.

ARTICLE 9 - RISK AND LIABILITY

9.1 The use of facilities in the Yu Pilates by Nicole Studio for activities such as strength, flexibility, and conditioning training, and/or participation in any class, training program, or activity of any kind at Yu Pilates by Nicole is entirely at the participant's own risk and responsibility.

9.2 The participant is obligated to inform Yu Pilates by Nicole, both before, during, and after any training under the guidance of an instructor, of their physical condition, such as injuries, illnesses, and/or other physical conditions, and to provide any information they reasonably deem necessary for the safe performance of exercises. The participant is responsible for providing this information.

9.3 Neither Yu Pilates by Nicole nor its staff are liable for material and/or immaterial damage arising from an accident or injury to the participant and/or third parties.

9.4 Yu Pilates by Nicole and its staff do not accept liability for any damage, loss, or theft of the participant's or third party's property.

9.5 The participant is liable for damage to Yu Pilates by Nicole's property if such damage results from the participant's negligence and/or fault.

9.6 The exclusions and limitations of liability outlined in this article also apply to the subordinates of Yu Pilates by Nicole and any other persons engaged by Yu Pilates by Nicole in the execution of the Participant Agreement.

Valuable Items and Personal Property

9.7 Participants acknowledge that they have been advised not to bring valuable items to the facilities of Yu Pilates by Nicole and that Yu Pilates by Nicole is not liable for loss, theft, or damage to personal property, including items left in lockers, bathrooms, studios, or elsewhere in the facilities. Participants acknowledge that no part of the fees they pay is intended to secure valuable items.

ARTICLE 10 - PERSONAL DATA AND PRIVACY POLICY

10.1 Each participant is aware that they provide certain personal data to Yu Pilates by Nicole, such as name, age, address, and email address. The personal data of participants will be treated with the utmost confidentiality and will only be used for administrative purposes at Yu Pilates by Nicole.

10.2 By agreeing to these Participant Terms, the participant grants Yu Pilates by Nicole permission to process their personal data for commercial purposes. Any processing of personal data by Yu Pilates by Nicole will comply with the Dutch Data Protection Act (Wbp). Yu Pilates by Nicole will delete any participant data upon written request from the participant.

10.3 Yu Pilates by Nicole may take photos or videos of classes or other areas within the studio for use on Yu Pilates by Nicole's social media or website. The participant is aware of this and grants their consent via

10.4 By agreeing to these Participant Terms, the participant explicitly consents to Yu Pilates by Nicole sending offers via email and other communication methods.

ARTICLE 11 - COMPLAINTS

11.1 A participant must report any complaint about Yu Pilates by Nicole's performance as soon as possible after the defect or damage is identified, and no later than fourteen (14) days after the participant notices the defect or damage. The complaint may be submitted by phone or email to Yu Pilates by Nicole via the official email channel: info@yupilatestudio.nl, with reference to the location and a description of the complaint.

11.2 The complaint must be fully and clearly described, along with supporting evidence.

11.3 Yu Pilates by Nicole will respond to the submitted complaint as soon as possible, but no later than four (4) weeks after receiving the complaint. If Yu Pilates by Nicole expects to require more time to process the complaint, this will be communicated immediately to the participant by email upon discovery.

11.4 If the complaint cannot be resolved through mutual consultation, a dispute arises as referred to in Article 13(4) of these Participant Terms.

ARTICLE 12 - WEBSITE AND MOBILE APP

12.1 The information on the website is intended solely for general informational purposes. Due to external circumstances, there may be delays, defects, and/or other shortcomings in the provided information.

12.2 Although Yu Pilates by Nicole exercises the utmost care in composing and maintaining its website, Yu Pilates by Nicole cannot guarantee that the provided information is complete, up-to-date, and/or accurate. Therefore, the participant hereby unconditionally and irrevocably waives their right to compensation for any direct or indirect damage arising from the use of personal data unless there is intent or gross negligence on the part of Yu Pilates by Nicole.

12.3 The third-party websites linked from the website are not controlled, created, or maintained by Yu Pilates by Nicole. Therefore, Yu Pilates by Nicole accepts no liability for the content of these linked websites.

12.4 The website and its content are protected by copyright, trademarks, and other intellectual property rights. No part of the Yu Pilates by Nicole website or its content may be reproduced, stored in an automated database, or made public in any form or by any means, whether electronic or mechanical, by photocopying, recording, or any other means, without prior written consent from Yu Pilates by Nicole.

ARTICLE 13 - APPLICABLE LAW AND COMPETENT COURT

13.1 These Participant Terms are effective from November 15, 2025, and may be modified or updated.

13.2 Deviations from these Participant Terms are only valid if confirmed in writing by Yu Pilates by Nicole.

13.3 In the event that any provision of these Participant Terms is declared invalid or void, this will not affect the validity of the remaining provisions. Yu Pilates by Nicole and the Participant will then consult to agree on new provisions to replace the invalid or void provisions, while preserving the goal and scope of the original provision as much as possible.

13.4 Any legal relationship with Yu Pilates by Nicole is governed by Dutch law. All disputes between the Participant and Yu Pilates by Nicole arising from or related to the Agreement will be exclusively settled by the competent court in the district of Amsterdam.

ARTICLE 14 - REQUIRED EQUIPMENT

14.1 The safety and physical well-being of participants are a priority at Yu Pilates by Nicole. To participate in our Reformer classes, it is mandatory for all participants (members and non-members) to wear grip socks and clean sportswear. Yu Pilates by Nicole reserves the right to refuse access to the class if a member chooses not to wear the required attire. In such a case, the member will not receive a refund for the class. Grip socks are mandatory for safety and hygiene reasons. Bring your own grip socks or purchase them at our reception. Barefoot or wearing shoes is not permitted.

PRIVACY STATEMENT

Yu Pilates by Nicole, headquartered at Hogewoerd 128, 2311HT, Leiden, Netherlands, is responsible for the processing of personal data as outlined in this privacy statement.
